Important Notes

Photographs

You must provide 6 passport-size photos of yourself and each family member applying with you. Photographs must comply with government photo specifications. On the back of each photo, write the name of the applicant and his or her A# number (if any).

Medical Examination

As applicants for adjustment of status, you and the family members applying with you must obtain a Form I-693 medical certificate from a physician authorized by USCIS, known as a civil surgeon. However, you are not required to submit the medical exam results with your application. We recommend that you wait to obtain a medical examination until USCIS issues a request for evidence (RFE) for exam results after your case is filed.

If you wish to submit a medical certificate with your application, you must make an appointment with an USCIS-authorized civil surgeon. Your medical examination must be completed no more than 60 days before your application is submitted. The civil surgeon will provide the exam results in a sealed envelope, which you must not open. Please request an unsealed copy for your records.

Travel Restrictions

As AOS applicants, you and your qualifying family members are subject to restrictions on international travel. If you do not comply with these travel rules, your AOS application could be considered abandoned.

  • At the time of filing of the AOS application(s), you and your qualifying family members must be physically present in the U.S.
  • Once your application is filed and pending with USCIS, you must follow these additional travel restrictions:
    • You, the principal adjustment applicant, must (1) be in valid H-1B or L-1 status, OR (2) possess a special travel document from USCIS known as "Advance Parole." If you depart the United States without either valid H-1B or L-1 status or a valid Advance Parole document, you will be considered to have abandoned your application for adjustment of status to permanent residence.
    • If your dependent spouse or child has a pending adjustment of status application, they must not depart the US until they have received an approved Advance Parole document.

Please contact your Fragomen Representative prior to making any international travel plans in the future.

I-765 / Employment Authorization Document

Your adjustment application package will contain a Form I-765 application for an employment authorization document (EAD) for yourself and your qualifying dependents. Confirm whether you would like to apply for U.S. Social Security number (SSN) or replacement Social Security card along with the I-765 application. If you already have a Social Security Card, there is no need to apply for a new one. If you request a Social Security card with your application, you should receive it within several weeks after you receive your approved EAD.

Next Steps After AOS Filing

Once the final application and supporting documents are filed with USCIS, the agency will send you and your dependent family members a notice to appear at a USCIS office to be fingerprinted and photographed for security clearance purposes.

Upon the completion of USCIS processing of the applications, USCIS may issue you and your dependent family members an appointment notice for an in-person interview. Our office will notify you if we receive such notice.
